Virginia is a partner in Wendel Rosen’s Trusts and Estates practice group. Compassionate and pragmatic, she guides clients in estate planning, trust administration, probate, and elder law matters. She is a skilled mediator, writes and speaks on a range of estate planning related topics, and is experienced in estate planning for LGBTQ families.

Trusts and Estates

Virginia advises clients on wealth preservation and estate planning, prepares estate planning documentation, including revocable trusts, wills, durable powers of attorney, and advance healthcare directives, and assists with advanced estate planning and irrevocable trusts. She guides clients on planning for disability, incapacity and end-of-life issues.

She has particular experience in estate planning for LGBTQ families, as well as representation of individual and professional fiduciaries in the administration of living trusts, conservatorships of the person and estate and decedents’ estates. As a former estates and trusts litigator, Virginia advises and consults with clients and colleagues about litigation matters.

Leadership and Experience

A frequent author and speaker on estate planning related issues, including LGBTQ estate planning, powers of attorney, estate planning in the context of dissolutions, and end of life decisions, Virginia has presented before a wide variety of legal, professional and private organizations. She is a former Certified Family Law specialist, mediates matters in her areas of expertise and is a Fellow of the American College of Trust and Estates Lawyers.

Daniel Rapaport

Dan is the firm’s managing partner. As one of Wendel Rosen’s senior litigators, he handles a wide array of complex business litigation, including unfair competition, trust and estate disputes, director and officer liability, and real estate disputes. He represents small and large companies, high net worth individuals, manufacturing concerns, distributors, real estate companies and public entities.

He is equally comfortable in the courtroom representing his clients’ interests or in the boardroom providing advice designed to avoid litigation. His ability to find creative resolutions of complex disputes often presents the best solution for clients.

Litigation

Dan litigates in varied substantive areas. In the last ten years he has successfully represented bankruptcy trustees in actions against debtors, officers, directors and other professionals for misconduct. He has also represented manufacturing companies against entities who have damaged them through unfair competition, contract disputes, and trade secret theft. He is often called upon to represent shareholders, officers and directors of closely held agricultural, real estate, manufacturing and technology companies that have internal conflicts.

Conflict Resolution

A stalwart problem solver, Dan focuses on efficient solutions and delivering results that impress his clients. He represents trustees, fiduciaries and beneficiaries of substantial estates and trusts in all types of fiduciary disputes. He represents public and private entities in contract disputes over real estate, land use, construction, and general commercial operations. He is frequently called upon to represent companies that manufacture regulated products for sale to consumers, regarding advertising and regulatory compliance with California and federal law. He also represents companies that sell products to consumers, regarding Proposition 65 compliance matters.

Kevin is a partner and Chair of the firm’s Trust & Estate Litigation Practice Group, with over a decade of experience representing fiduciaries, beneficiaries and nonprofit organizations in contested trust, estate, conservatorship, and elder abuse matters. Kevin represents his clients in all phases of litigation, from pre-litigation avoidance to mediation, trial and, if necessary, appeal.

While Kevin now focuses his practice exclusively on litigation matters, he also has an LL.M. in Taxation and has an extensive background in estate planning, trust and probate administration, and estate and gift taxation.

Pragmatic, diligent, and tenacious, Robin provides trusted counsel to clients, is skilled at investigation and assessment, and is highly experienced at achieving successful outcomes.

Litigation

With a focus on appellate work in state and federal courts, Robin is experienced litigating a broad range of issues, including complex business matters involving real property, contracts, business tort claims, and bankruptcy issues.

She has significant experience litigating disputes involving commercial loan documents, deeds of trust, title to real property, various business contracts, as well as trust and probate instruments. She has also handled matters related to public agency contracts and the Brown Act “open meetings” law.

Land Use Compliance and Litigation

Robin is experienced in disputes concerning land use permitting. Her land use litigation and compliance work includes cases involving the California Environmental Quality Act (CEQA), the Subdivision Map Act, Section 404 permitting under the Clean Water Act, the public trust doctrine, the Endangered Species Act (including Section 7 consultations), and the National Environmental Policy Act (NEPA).
