New Rule: Hammerlock Admissible Testimony — The Implications of Sanchez and Stamps on Expert Witness Testimony in Valuation Litigation

Hulberg, MAI, Senior Managing Director at Valbridge Property Advisors, to present at the virtual 2021 Spring Litigation Conference hosted by the Appraisal Institute Northern California Chapter on May 13, 2021. The dynamic panel will discuss the implications of Sanchez and Stamps on expert witness testimony in valuation litigation.

Appraisers have long been accustomed to the expert’s exception to prohibition of hearsay testimony. Two recent California Supreme Court cases – Sanchez and Stamps – upend that tradition. “Case specific” information is likely to be barred. This is exactly the sort of testimony that is routine. A statement as innocuous as “the planner told me my subject is likely to be rezoned” is now barred. This session will explore some of the strategies to deal with this new world.
